Overview

These Terms of Use (“Terms”) govern your use of the Tap and Call web application (tapandcall.com) and related services. Tap and Call is a product of Maker Gully LLC (“we,” “us,” or “our”). By creating an account, using the service, or completing a purchase, you agree to these Terms and our Privacy Policy.

Eligibility

Tap and Call is available globally. FlairTag hardware ships within the United States only. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or place an order. You are responsible for ensuring your use complies with applicable local laws.

Accounts

You need an account to use Tap and Call after you buy, including a FlairTag you received in person or as a gift. You agree to provide accurate information, keep your credentials secure, and notify us if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Purchases and payment

When you buy FlairTag or Bring Your Own (BYO) NFC slots through the website, you are purchasing directly from Maker Gully LLC. Prices and options are shown at checkout. FlairTag hardware is sold per tag; you choose style, size, and quantity before you pay. For FlairTag, sales tax (if applicable) is calculated from your US shipping address and displayed before you pay. A FlairTag sold or given outside the website is the same product. You receive a claim code on a printed insert. That code adds the FlairTag to your account. The code is not on the tag. A claimed FlairTag cannot be claimed by someone else.

• Card payments are processed by Stripe. Payment forms on our site are provided by Stripe. We do not store full card numbers on our servers.
• Stripe collects and processes payment data under Stripe’s terms and privacy policy.
• By completing checkout, you authorize us (through Stripe) to charge the total shown for your order.
• We may refuse or cancel orders (for example, due to suspected fraud, invalid addresses, or product unavailability) and will refund any captured payment when appropriate.

Business software plans may also be offered. Plan options, setup fees, recurring software charges, upgrades, and applicable sales tax are shown in your account before you pay. Those plans may renew automatically until you cancel from account settings; guest tap features for that business may pause after the paid period ends or if renewal payment fails. You may update the card on file from account settings. Card details are handled by Stripe as described above.

Bring Your Own (BYO) NFC slots

BYO lets you use your own NFC tags with Tap and Call. You buy software slots only. We do not ship hardware.

• You supply and program compatible NFC tags. Slot fees do not include physical tags.
• BYO purchases are digital. Fees are non-refundable once payment succeeds.
• You are responsible for tag quality, programming, and how those tags are used.

Shipping and fulfillment

Each FlairTag is custom 3D-printed and programmed to order. Estimated delivery times are shown at checkout but are not guaranteed. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing a valid US shipping address. BYO slots have no shipping.

Returns and replacements

Because FlairTag is made to order, we do not accept physical returns for change of mind. Defective or non-working tags and lost shipments are covered by our Returns & Replacements Policy, which is incorporated into these Terms by reference. That policy applies to FlairTag hardware only, not to BYO slot purchases.

FlairTag and BYO use

FlairTag and registered BYO tags use NFC and work with supported smartphones. You are responsible for how you configure tags (alerts, check-ins, WiFi guest pass, redirects, timers, Keepsake notes and recordings, business guest actions, review links, and similar modes) and for complying with laws that apply to notifications, location sharing, and data you collect from people who tap your tags, including guest requests and private guest feedback. Do not use Tap and Call for unlawful, harassing, or deceptive purposes.

If you use Keepsake, anyone who taps that tag may hear the recording or read the note. You are responsible for that content. Do not record someone without their consent. Do not save unlawful or harassing content. We may remove a note or recording that violates these Terms. People who tap can report the page from Report this.

Service availability

We strive to keep Tap and Call available but do not guarantee uninterrupted access. Features, pricing, and these Terms may change. We will post material changes on this page and update the effective date where practicable. Continued use after changes constitutes acceptance of the updated Terms.

Disclaimers

Tap and Call and FlairTag are provided “as is” to the fullest extent permitted by law. We do not warrant that the service will prevent harm, loss, or emergency situations. FlairTag is a convenience tool, not a substitute for professional monitoring, medical care, or emergency services.

Limitation of liability

To the maximum extent permitted by law, Maker Gully LLC and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of Tap and Call or FlairTag. Our total liability for any claim relating to the service or a purchase is limited to the amount you paid us for the order giving rise to the claim in the twelve months before the claim.

Governing law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where US federal law applies. Disputes shall be resolved in the state or federal courts located in Connecticut, and you consent to personal jurisdiction there.
