Overview
These Terms of Use (“Terms”) govern your use of the Tap and Call web application (tapandcall.com) and related services. Tap and Call is a product of Maker Gully LLC (“we,” “us,” or “our”). By creating an account, using the service, or completing a purchase, you agree to these Terms and our Privacy Policy.
Eligibility
Tap and Call is available globally. FlairTag hardware ships within the United States only. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or place an order. You are responsible for ensuring your use complies with applicable local laws.
Accounts
You may need an account to order FlairTag and use the service. You agree to provide accurate information, keep your credentials secure, and notify us if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.
Purchases and payment
When you buy FlairTag through the website, you are purchasing directly from Maker Gully LLC. Prices, pack options, and styles are shown at checkout. Sales tax (if applicable) is calculated from your US shipping address and displayed before you pay.
- Card payments are processed by Stripe. We do not store full card numbers on our servers.
- Stripe collects and processes payment data under Stripe’s terms and privacy policy.
- By completing checkout, you authorize us to charge the total shown for your order.
- We may refuse or cancel orders (for example, due to suspected fraud, invalid addresses, or product unavailability) and will refund any captured payment when appropriate.
Shipping and fulfillment
Each FlairTag is custom 3D-printed and programmed to order. Estimated delivery times are shown at checkout but are not guaranteed. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing a valid US shipping address.
Returns and replacements
Because FlairTag is made to order, we do not accept physical returns for change of mind. Defective or non-working tags and lost shipments are covered by our Returns & Replacements Policy, which is incorporated into these Terms by reference.
FlairTag use
FlairTag uses NFC technology and works with supported smartphones. You are responsible for how you configure tags (alerts, check-ins, WiFi guest pass, redirects, and similar modes) and for complying with laws that apply to notifications, location sharing, and data you collect from people who tap your tags. Do not use Tap and Call for unlawful, harassing, or deceptive purposes.
Service availability
We strive to keep Tap and Call available but do not guarantee uninterrupted access. Features, pricing, and these Terms may change. We will post material changes on this page and update the effective date where practicable. Continued use after changes constitutes acceptance of the updated Terms.
Disclaimers
Tap and Call and FlairTag are provided “as is” to the fullest extent permitted by law. We do not warrant that the service will prevent harm, loss, or emergency situations. FlairTag is a convenience tool, not a substitute for professional monitoring, medical care, or emergency services.
Limitation of liability
To the maximum extent permitted by law, Maker Gully LLC and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of Tap and Call or FlairTag. Our total liability for any claim relating to the service or a purchase is limited to the amount you paid us for the order giving rise to the claim in the twelve months before the claim.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where US federal law applies. Disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
